Before work is carried out on any tree we check with the Local Authority. If there is a TPO on it or the tree is in a Conservation Area the relevant permissions will be applied for by us.
It is extremely important to make sure you have all the necessary permissions, as it could result in being taken to magistrates’ court and fined if convicted.
You do have the right to cut the branches back to the boundary and you do not need the consent of the tree owner before doing so. There are some limitations to this: the cutting back must not make the tree unstable or cause it to die; the branches should be offered to the tree owner; and you should make sure that the tree is not in a Conservation Area and there is not a TPO order on as this is a criminal offence.
